Terms & Conditions of Mindful Arthritis Method Beta Program
Purchase Terms for Mindful Arthritis Method – BETA program.
In accordance with Distance Selling Regulations, the Client has the right to cancel and obtain a full refund within 14 days of purchase.
Refund requests should be made in writing to email@example.com and a full refund will be provided within 10 working days from the date of the request.
In the event that one or more coaching sessions have already taken place within the first 14 days following purchase, the Client is still entitled to request a refund but the value of the coaching session(s) shall be deducted from the amount paid by the Client, along with any reasonable costs which have been incurred by the Coach. The value of any sessions which have been provided (or deemed provided due to late cancellation), will be determined pro-rata and will include any preparatory time completed by the coach.
There is no obligation on the coach to refund any amounts paid where cancellation requests are made following the 14-day cancellation period.
Should the Client wish to obtain a refund outside of the 14 day cancellation period they should set out their request in writing and send it to firstname.lastname@example.org
The Mindful Arthritis Beta program includes the following:
6 x 60-minute coaching sessions
3 x Months access to Autoimmune Circle Pro.
3 x Months access to Autoimmune Circle
After 3 months you will be able to purchase access to these memberships by paying a monthly subscription. If you choose not to purchase the subscription you will lose access.
The coach hereby grants to the Client a non-exclusive, non-transferable, royalty-free, worldwide, personal licence to use, copy, maintain and store any materials provided during the coaching period
The coach shall retain the copyright in all Materials.
This licence does not allow the Client to copy, distribute, adapt, edit or share the Materials with third parties.
Limitations and exclusions of liability
The coach shall not be liable to the Client in respect of any loss or damage which may arise for the duration of the program.
The coach shall not be responsible for any decisions taken or not taken by the Client. The coach cannot guarantee results or outcomes of any kind or over any period.
From time to time the coach may share testimonials or results achieved by other clients. Such testimonials are not an inducement and do not act as a guarantee that similar results will be achieved by the Client.
The coach is reliant on the Client to provide open and honest disclosure of their circumstances. The coach shall not be liable to the Client in respect of any situation whereby full disclosure and information is not provided.
From time to time during the provision of the Mindful Arthritis Method, the coach may make recommendations for additional professional support from third parties. The coach shall not be responsible for the provision of any services by any third parties and makes no guarantee in respect of any recommendations.
None of the services delivered by the coach shall be construed as medical, nutritional, or psychological advice and the Client should seek input from qualified professionals in these specialisms.
In the event that the Client does incur damages as a result of this Agreement, the entire liability is limited to the total Fee paid at the time of any alleged loss.
The coach acknowledges that in the course of the Engagement, it will have access to Confidential Information.
The coach shall not (except in the proper course of the provision of the Mindful Arthritis Method) either during the Engagement or at any time after the Term, use or disclose to any person, organisation or company and shall use its best endeavours to prevent the publication of, any Confidential Information or the Client’s Intellectual Property. This restriction does not apply to any use or disclosure authorised by the Client or required by law. Neither does it apply to any information which is already in, or comes into, the public domain, otherwise than through the coaches unauthorised disclosure of the same.
The coach may share the details of the coaching sessions with their supervisor/mentor. As far as possible, the coach shall not disclose any identifiable information about the Client to their supervisor. The supervisor/mentor shall at all times be bound by client confidentiality and professional restrictions not to disclose details to third parties in any event.
The coach is permitted to share that there is a working relationship between the Parties. Any sharing on social media will be limited to sharing feedback the client gives during or after sessions with no information that identifies that client, re-posting any posts by the Client which directly refer to the coach via social media and/or using testimonials with permission.
Booking/Canceling/Rescheduling Coaching Sessions
The Client will book all coaching sessions via the link shared via email after the purchase is complete. It is the client’s responsibility to schedule ALL sessions.
Sessions will be held
– between 2pm and 9pm GMT Mondays
– between 6pm and 9pm GMT Thursdays and Fridays
The coach will provide a total of 6 weekly sessions.
All coaching sessions for this beta program must be completed by no later than 8 weeks post-purchase.
The client may reschedule a coaching session using the rescheduling link contained in their appointment confirmation email, up to 24 hours before their booking. This can be done at no additional cost and no further correspondence with Aisling Maher is necessary
If the client cancels their coaching session less than 24 hours before the start time the session may not be rescheduled and this will be considered a complete session. If there is an urgent reason the session needs to be cancelled or rescheduled within 24 hours of the start time, the coach can, at her discretion, rearrange the session at no additional cost.
If a client is late to a session the session will still finish at the scheduled time
If a client is late the coach will stay on the line for 15 minutes after the session has started. If the client does not show up the session will be forfeited. Missing an appointment without notice is considered a complete session.
If the coach is more than 15 minutes late, the session will be rescheduleded at no extra cost to the client.
Should you consider that you have grounds to obtain a refund that is not set out above you should email email@example.com to set out your refund request.
All refunds are provided in accordance with your statutory rights.
Coach’s availability outside of sessions
The coach will be available to respond to questions and queries raised by the Client by email and Voxer outside of the coaching sessions.
The coach will respond as soon as possible and unless prohibited will respond within 48 hours providing that the request is made on a weekday.
Otherwise, the response will follow on the next weekday, excluding Bank Holidays (Ireland) and any other notified period of leave in advance.
From time to time, depending on the detail of the question it may be that the question is best
answered at the beginning of the next coaching session, as the query may be due to be
covered then in any event.
The Mentor’s days of operation are Monday, Thursday and Friday. The coach will be available
during the core hours Mon 2-8 PM, Thurs & Fri 6-9PM GMT/BST.
It may be possible for the coach to
respond outside of these hours but this should not be assumed and cannot be guaranteed.
The Client should be aware that from time to time, as part of the Coach’s own content strategy, pre-drafted social media content is scheduled and will be posted to social media channels outside of regular office hours, including at weekends.
This does not mean that the Coach will be able to respond and provide one-to-one support as they
may not be monitoring their account at the time the content is posted.
The addition of new content indicates that other elements of the business are operating, such as the
marketing function, but not necessarily coaching.
Law and Jurisdiction
These terms and any claim or dispute arising in relation to any purchase will be governed by Irish law. You and we agree that the courts of Ireland shall have non-exclusive jurisdiction to settle any such claim or dispute.
